Privacy Policy
Your Privacy, Data, Cookies & Third-Party Services
Personal Statement
XCLSV is operated by Maiden Labs LLC (“Maiden Labs,” “XCLSV,” “we,” “us,” or “our”). We are committed to creating a trusted, transparent, and secure environment for collectors.
We understand that privacy is an important part of that experience. This Privacy Policy explains what information we may collect, how we collect and use it, when we may disclose it, how long we may retain it, and the choices and rights that may be available to you.
This Privacy Policy applies to XCLSV websites, applications, services, features, communications, and other services that link to this Privacy Policy (collectively, the “Services”).
By accessing or using the Services, you acknowledge that you have read and understood this Privacy Policy.
What Information Do We Collect?
We may collect information that you provide directly to us, information generated through your use of XCLSV, information provided by other users, and information received from third-party service providers.
Information you provide may include your name, username, email address, profile photograph, biography, social media links, location information you choose to display, collector interests, account preferences, communications, and other information you choose to include in your profile.
When you add collectibles to XCLSV, we may process information including photographs, descriptions, categories, manufacturers, athletes, characters or subjects, grading information, certification or serial numbers, purchase information, asking prices, sale status, ownership status, transaction history, and other information associated with those collectibles.
If you buy, sell, make or receive offers, communicate with another user, or otherwise participate in transactions through the Services, we may collect information related to those activities.
We may also automatically collect technical and usage information such as IP address, browser type, device type, operating system, referring URLs, pages viewed, features used, approximate location derived from IP address, timestamps, session information, identifiers, cookie information, and information regarding your interactions with the Services.
Public Profile and Collectible Information
XCLSV is designed in part to allow collectors to showcase their identities and collections. Information you choose to make public may therefore be visible to other users and, depending on your settings and our product features, to the general public and search engines.
Public information may include your username, profile photograph, profile description, collectible images, collection information, items marked as owned, wanted, for sale, or not for sale, transaction or reputation information, and other information you choose to display publicly.
You should not post information publicly that you do not want others to view, copy, save, share, index, or otherwise use.
Removing information from XCLSV does not necessarily remove copies previously saved, shared, indexed, cached, or otherwise retained by third parties.
How Do We Use Your Information?
We may use information we collect to operate, maintain, develop, personalize, secure, and improve XCLSV and to provide the features available to our community.
This may include creating and managing accounts; displaying profiles and collections; facilitating offers, transactions, communications, and other interactions between users; authenticating users; verifying information; providing customer support; processing transactions; preventing fraud, scams, abuse, manipulation, and other prohibited activity; enforcing our Terms of Service and other policies; resolving disputes; improving search and recommendations; analyzing how the Services are used; developing new products and features; and communicating with you about XCLSV.
We may also use information to comply with applicable law, respond to lawful requests, establish or defend legal claims, protect XCLSV and its users, and protect the rights, property, security, and safety of Maiden Labs LLC, our users, third parties, and the public.
Identity and Account Verification
XCLSV may offer or require identity, account, collectible, transaction, or other verification features.
Verification may be performed by us or by third-party verification providers. Depending on the verification method used, information processed may include your legal name, date of birth, address, government-issued identification, photographs, verification results, device information, or other information necessary to confirm identity or prevent fraud.
Where a third-party verification provider performs verification, certain information may be collected and processed directly by that provider under its own privacy terms.
XCLSV may receive verification results, status information, risk indicators, or other information from such providers without necessarily receiving or storing all underlying identity documentation.
We seek to collect and retain sensitive information only where reasonably necessary for the applicable purpose.
Payments and Financial Information
Transactions facilitated through XCLSV may involve third-party payment processors, financial institutions, escrow providers, marketplaces, or other payment services.
Payment information may be submitted directly to these providers. Depending on how a transaction is structured, XCLSV may receive limited information concerning a payment or transaction, such as payment status, transaction amount, payment method type, transaction identifier, refunds, disputes, or related information.
Unless expressly stated otherwise, XCLSV does not intend to directly store complete payment card numbers or bank account credentials when those details are processed by an independent payment provider.
Third-party payment services are subject to their own terms and privacy practices.
Communications Between Users
XCLSV may provide messaging, offers, comments, inquiries, or other communication tools.
We may process and retain communications sent through the Services as reasonably necessary to provide those features, prevent fraud and abuse, investigate disputes or reports, enforce our policies, improve our Services, comply with law, and protect users.
Users should exercise caution before sharing personal, financial, shipping, or other sensitive information with another user.
Cookies and Similar Technologies
We and our service providers may use cookies, pixels, local storage, software development kits, tags, and similar technologies to operate and improve XCLSV.
These technologies may be used to keep you signed in, remember preferences, maintain security, detect fraud, understand how users interact with XCLSV, measure performance, diagnose technical problems, and improve the Services.
Where required by applicable law, we will provide appropriate choices concerning non-essential cookies or similar technologies.
You may also be able to control certain cookies through your browser or device settings. Disabling cookies may cause some XCLSV features to function differently or become unavailable.
Analytics
We may use third-party analytics and technology providers to help us understand how people use XCLSV, measure performance, diagnose problems, prevent abuse, and improve the Services.
These providers may process technical and usage information such as device information, IP address, browser information, pages viewed, session activity, and interactions with the Services.
The providers we use may change as XCLSV develops.
How We Disclose Information
We may disclose personal information when reasonably necessary to operate XCLSV and provide the Services.
Recipients may include hosting and infrastructure providers, cloud service providers, payment processors, identity-verification providers, fraud-prevention providers, analytics providers, email and communication providers, customer-support providers, professional advisers, insurers, auditors, contractors, and other vendors that perform services for us.
Information may also be disclosed to another user when necessary to facilitate a transaction or interaction requested by you.
We may disclose information where we reasonably believe disclosure is necessary to comply with applicable law, regulation, legal process, court order, or governmental request; investigate or prevent fraud or illegal activity; enforce our agreements and policies; protect our legal rights; or protect the rights, property, security, or safety of XCLSV, our users, third parties, or the public.
Sale or Sharing of Personal Information
XCLSV does not sell personal information for money as part of its ordinary business model.
Certain privacy laws, however, define “sale” or “sharing” more broadly than an ordinary exchange of information for money. For example, certain advertising or analytics technologies may potentially constitute “sharing” or a “sale” under applicable state privacy laws depending on how those technologies are implemented.
Where applicable law provides a right to opt out of such practices, XCLSV will provide the required mechanism for exercising that right.
We will update this Privacy Policy as our practices and Services evolve.
Third-Party Services
XCLSV may integrate with or link to third-party websites, applications, social networks, payment services, verification providers, grading companies, marketplaces, shipping services, or other third-party services.
Your use of a third-party service may allow that third party to collect or receive information about you.
We do not control the privacy, security, or data practices of independent third parties. Their collection and use of information are governed by their own terms and privacy policies.
Links to or integrations with third-party services do not necessarily constitute an endorsement of their privacy or security practices.
Social Media and Connected Accounts
XCLSV may allow you to connect, display, or interact with third-party accounts or social networks.
If you choose to connect a third-party account, we may receive information permitted by you and the applicable third-party service, such as your username, profile information, account identifier, or other authorized information.
You can generally control information made available by connected services through the settings provided by those services.
Data Security
We use administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, and disclosure.
However, no website, application, database, network, or method of electronic transmission or storage can be guaranteed to be completely secure. Accordingly, we cannot guarantee the absolute security of information processed through XCLSV.
You are responsible for maintaining the confidentiality of your account credentials and should notify us promptly if you believe your account has been compromised.
Data Retention
We retain personal information for as long as reasonably necessary for the purposes for which it was collected, including providing the Services, maintaining accounts, facilitating transactions, resolving disputes, preventing fraud and abuse, complying with legal and regulatory obligations, enforcing agreements, and establishing or defending legal claims.
Retention periods may vary depending on the nature of the information and our legal or operational requirements.
Information may remain in backups for a limited period after deletion from active systems. We may also retain information where required or permitted by law, including information necessary for fraud prevention, security, dispute resolution, accounting, or legal compliance.
We may retain information in aggregated or de-identified form where it can no longer reasonably be associated with you, subject to applicable law.
Your Choices and Account Controls
Depending on the features available through XCLSV, you may be able to access, update, correct, remove, or change the visibility of certain information through your account settings.
You may also request assistance by contacting us at support@xclsvcollectibles.com.
You may unsubscribe from promotional emails by using the unsubscribe mechanism contained in those communications. We may continue to send non-promotional communications relating to your account, transactions, security, policy changes, or other service-related matters.
Your Privacy Rights
Depending on where you live and applicable law, you may have rights concerning your personal information.
These may include the right to request access to personal information; obtain information concerning how it is collected, used, or disclosed; request correction; request deletion; obtain a portable copy of certain information; opt out of certain sales, sharing, targeted advertising, or profiling; limit certain uses of sensitive personal information; and appeal certain decisions concerning privacy requests.
We will not unlawfully discriminate against you for exercising applicable privacy rights.
We may need to verify your identity before processing certain requests. We may also deny or limit a request where permitted or required by law.
California Privacy Rights
If the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA”), applies to XCLSV and your personal information, California residents may have additional rights.
Depending on our applicable practices and legal obligations, these rights may include the right to know the categories and specific pieces of personal information collected; categories of sources; business or commercial purposes for collecting, selling, or sharing information; categories of third parties to whom information is disclosed; correction of inaccurate information; deletion of certain information; opting out of the sale or sharing of personal information; limiting certain uses or disclosures of sensitive personal information; and freedom from unlawful discrimination for exercising CCPA rights.
California residents may submit applicable privacy requests using the contact information provided below or through privacy-request mechanisms that XCLSV may make available.
Where legally required, authorized agents may submit requests on behalf of California residents, subject to appropriate verification and authorization procedures.
Categories of Personal Information
Depending on how you use XCLSV, we may collect categories of personal information including identifiers; customer-record information; commercial information; internet or electronic network activity; approximate geolocation information; photographs and other visual information; account and profile information; transaction information; user-generated content; communications; and inferences derived from your activity or preferences.
If verification or another feature requires sensitive personal information, we may process categories such as government identification information, account credentials, precise information supplied for verification, or other information considered sensitive under applicable law.
We collect and use these categories only for purposes described in this Privacy Policy or otherwise disclosed at the time of collection.
Notice at Collection
At or before the point where required personal information is collected, XCLSV may provide additional notices describing the categories of information being collected and the purposes for which that information will be used.
Those notices supplement this Privacy Policy.
Where required by applicable law, XCLSV will not collect additional categories of personal information or use collected information for materially different purposes without providing appropriate notice.
Children’s Privacy
XCLSV is not directed to children under 13, and we do not knowingly collect personal information from children under 13 in violation of applicable law.
If we learn that personal information from a child under 13 has been collected in circumstances requiring parental consent without appropriate consent, we will take reasonable steps to delete that information.
If you believe a child has provided personal information to XCLSV inappropriately, please contact us at support@xclsvcollectibles.com.
International Users
XCLSV is operated from the United States.
If you access the Services from outside the United States, your information may be transferred to, stored in, or processed in the United States or other jurisdictions in which we or our service providers operate.
Data protection laws in those jurisdictions may differ from those in your country of residence.
Where legally required, we will implement appropriate mechanisms governing international transfers of personal information.
Business Transfers
If Maiden Labs LLC or XCLSV is involved in a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, corporate transaction, or transfer of all or part of its business, information associated with the Services may be disclosed or transferred as part of that transaction or related due diligence, subject to applicable law.
Any successor entity may continue to process information in accordance with this Privacy Policy unless otherwise disclosed or required by law.
Legal Requests and Protection of XCLSV
We may preserve, access, or disclose information when we reasonably believe doing so is necessary to comply with applicable law or legal process; respond to lawful governmental requests; investigate fraud, theft, scams, counterfeiting, abuse, security incidents, or violations of our policies; enforce our agreements; protect our legal rights; or protect XCLSV, Maiden Labs LLC, our users, third parties, or the public.
Where legally permitted, we may challenge requests that we believe are invalid, overbroad, or otherwise inappropriate.
Changes to This Privacy Policy
We may modify this Privacy Policy from time to time to reflect changes to XCLSV, our business practices, technology, legal requirements, or other circumstances.
When we make changes, we will update the “Last Updated” date at the top of this Privacy Policy.
If changes are material, we may provide additional notice as required by applicable law, including through the Services or by email.
Your continued use of XCLSV following the effective date of an updated Privacy Policy is subject to the updated policy, to the extent permitted by law.
